Plowed? ("the Site") is an independent, community-driven project. It is not affiliated with, endorsed by, or operated by the City of Somerset, Massachusetts, or any municipal, state, or federal government agency. Any reference to Somerset streets or city infrastructure is for informational purposes only and does not imply any official relationship.

You must be at least 13 years of age to use the Site. By using the Site, you represent that you meet this requirement.

5. No Guarantee of Accuracy

All plowing status data displayed on the Site is submitted by anonymous community members and is not verified by any authority. The Site owner makes no representations or warranties, express or implied, regarding the accuracy, completeness, reliability, or timeliness of any information displayed. Street names, plowing statuses, and geographic data may be inaccurate, outdated, incomplete, or mislabeled.

To the fullest extent permitted by law, the Site owner, operators, contributors, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with your use of, or inability to use, the Site or any information provided on it. This includes, without limitation, damages resulting from:

The Site does not make any claims about the performance, competence, or conduct of the City of Somerset, its employees, contractors, or any other individual or entity. Plowing statuses reflect anonymous community reports only and are not editorial statements, opinions, or assertions of fact by the Site owner. The Site owner expressly disclaims responsibility for any interpretation of user-submitted data as a factual claim about any person, organization, or government body.

8. Use at Your Own Risk

You use the Site entirely at your own risk. Always exercise independent judgment regarding road conditions. Do not rely solely on this Site for safety-critical decisions. When in doubt, contact the City of Somerset directly for official plowing information.

9. Indemnification

You agree to indemnify, defend, and hold harmless the Site owner and its affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from your use of the Site, your violation of these Terms, or your submission of any data to the Site.

10. Geographic and Road Data

Road geometry data is derived from publicly available sources including MassGIS and OpenStreetMap. This data may not reflect current road configurations. The Site owner makes no warranty regarding the accuracy of road geometry or street name data.

11. Third-Party Services

The Site relies on third-party infrastructure including Cloudflare (networking and hosting) and mapping providers. Your use of the Site may be subject to those providers' terms as well. We are not responsible for the practices or content of third-party services.

12. Intellectual Property

The Site's software, design, and original content are owned by the Site operator or its contributors. Community-submitted data (votes, reports) is licensed to us as described in Section 4. You may not reproduce, distribute, or create derivative works from the Site without written permission.

13. Future Account Features

We plan to offer optional user accounts in the future. Additional terms governing account creation, use, and termination will be published at that time. Account creation will always be optional.

14. Modifications

The Site owner reserves the right to modify these Terms at any time. Changes will be reflected by an updated "Last updated" date. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

15. Termination

We reserve the right to restrict or terminate access to the Site for any user or entity that violates these Terms or engages in abusive, fraudulent, or harmful behavior, without prior notice.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
